Terms of Service
Preamble & Scope
Supabrand is an AI-powered brand management platform operated by Gartenbach Management Consulting, registered in Switzerland under CH-400.1.604.190-0.
By creating an account or using the service, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service.
The service is available to businesses and individuals aged 18 or older.
Account & Registration
- You must provide accurate and complete information when creating your account.
- One organization account is permitted per legal entity.
- You are responsible for maintaining the security of your account credentials and for all activities under your account.
- We reserve the right to suspend or terminate accounts that violate these terms.
Service Description
Supabrand is an AI-powered brand management platform based on the Narrative Context Protocol (NCP).
Features include: Context Cards, Content Generation, Brand Checker, Profiling Agents, Campaign Orchestration, Content Calendar, and NCP Export.
AI-generated content is provided as suggestions. You are solely responsible for reviewing, editing, and publishing any content created using the service.
Service availability target: 99.5% uptime. No SLA guarantee is provided on the free tier.
Subscription & Billing
- Three subscription tiers are available: Light (EUR 79/month), Pro (EUR 249/month), and Enterprise (EUR 699/month).
- A 14-day free trial is available on the Pro tier. No credit card is required for the trial.
- Billing is processed via Stripe on a monthly or annual basis. Annual plans include 2 months free (17% discount).
- All prices exclude applicable VAT, which is calculated based on your location.
- Price changes will be communicated at least 30 days in advance.
- Enterprise tier overage: EUR 0.08 per generation above the included 2,000 per month.
Cancellation & Refund
- You can cancel your subscription at any time via account settings or the Stripe Customer Portal.
- Access to paid features remains until the end of your current billing period.
- No prorated refunds are issued for partial months. Annual plans take effect at the end of the annual term.
- EU consumers are entitled to a 14-day cooling-off period (Widerrufsrecht) from the initial subscription date, with a refund of the unused portion.
- Free tier accounts can be deleted at any time without notice.
Intellectual Property
- You retain full ownership of all content created using Supabrand.
- You retain full ownership of all brand data entered into the platform (Context Cards, Beats, Constraints, Buyer Intents, etc.).
- Supabrand retains ownership of the platform, the NCP schema implementation, and proprietary AI integrations.
- AI-generated content: you own the output. Supabrand claims no rights to content generated for you.
- We do NOT use customer brand data or generated content to train AI models.
- NCP JSON exports: you control the publication and distribution of your exported brand data.
Data & Privacy
- Please refer to our Privacy Policy for full details on how we handle your data.
- Data is stored in the EU (Supabase, Frankfurt region).
- Data processing complies with the Swiss Federal Act on Data Protection (DSG) and the EU General Data Protection Regulation (GDPR).
- Customer data is never shared with third parties except as required for service delivery (Anthropic API for content generation, Stripe for billing).
AI-Specific Terms
- AI outputs are machine-generated suggestions and do not constitute professional advice of any kind.
- Supabrand does not guarantee the accuracy, completeness, or appropriateness of AI-generated content.
- You are solely responsible for reviewing, editing, and approving all content before publication.
- Please refer to the Acceptable Use Policy for content restrictions and prohibited uses.
Liability
- The service is provided "as is" without warranties of any kind, whether express or implied.
- Our maximum aggregate liability is limited to the total fees you paid in the 12 months preceding the claim.
- We are not liable for any indirect, consequential, incidental, or punitive damages.
- Neither party is liable for failures caused by events beyond reasonable control (force majeure), including but not limited to natural disasters, government actions, or service provider outages.
Modifications
We may update these Terms of Service from time to time. Changes will be communicated at least 30 days in advance via email to your registered address.
Continued use of the service after the notice period constitutes acceptance of the updated terms.
Material changes that significantly affect your rights will require active re-consent.
Governing Law & Jurisdiction
- These terms are governed by the laws of Switzerland.
- Any disputes arising from these terms shall be resolved in the courts of Zurich, Switzerland.
- EU consumers retain the right to bring claims in their local jurisdiction in accordance with applicable consumer protection laws.
